KTN3 NEWS.The Supreme Court is scheduled to hold its first pre-trial conference at 7 pm, Saturday, August 26, and the National Super Alliance as well as co-respondents, President Uhuru Kenyatta and the Independent Electoral and Boundaries Commission are expected to be present.
In their petition, NASA alleged that the IEBC declared Uhuru Kenyatta the president with unverified results because they were not in possession of all 290 Form 34B constituency results.
In their submissions seen by ktn3.com, NASA alleged that after Wafula Chebukati made the declaration on Friday, August 11, Returning Officers and Presiding Officers were summoned to adjust results on the forms.
“Having declared results unsubstantiated and unverified by the requisite forms, in order to cover its nakedness, the IEBC resorted to summon its officers to fill in and sign away the various forms so that the forms would tally with the declared results,” said Raila Odinga and Kalonzo Musyoka in their petition.
As proof of this alleged manipulation of forms, the opposition brigade listed Meru Primary School as one of the locations where forms were manipulated .
“In Meru Primary, all agents signed the forms using one handwriting and no results are given. In Kathugu Primary, the purported Form 34 A shows the party agent to be a NASA agent while the third respondent is shown as the candidate,
“In Gem constituency, the stamp used is inconsistent with the Returning Officer’s official stamp. The same was seen in Konoin and North Imenti,” submitted NASA.
However, the poll body, as they submitted their response, claims that Chubukati declared Uhuru the winner while in full possession of all verified results and documents. They also welcomed the opposition and any other interested parties to go through their submission because they carried out an election above reproach. The IEBC had allegedly been forced to announce president Kenyatta as winner. The court may decide to rule in Odinga’s favour and Chebukati and his team may be forced to give a new certificate to Odinga or conduct another election in a proper manner. .
